Buy American Act

 

Included in this law is a provision, Section 1605, which prohibits the use of recovery funds for the construction, alteration, maintenance or repair of a public building or public work unless all the iron, steel and manufactured goods used in the project are produced in the United States. There is no requirement with regard to origin of components or subcomponents in manufactured goods used in the project, as long as the manufacturing occurs in the United States.

 

Unfortunately, there has been confusion in regards to this most recent "Buy American" Act. Currently there are three (3) Acts which refer to "Buy American":


1)  (ARRA) Pubic Law 111-5 Section 1605 “Buy American” provision as stated above.

 

2)  Buy American Act 41 U.S.C. 10a-d of 1933 (BAA) which requires that supplies for public use be manufactured in the United States substantially all from articles, material or supplies mined, produced or manufactured in the United States. "Substantially all" has been defined as 50% of the component cost must be domestically produced items.

 

3)  Federal Buy America - This is the Federal Transit Administration's (FTA) program which traditionally focused on steel for railways and rolling stock. In 2009 the act was updated to include all manufactured products used on FTA-funded projects.  Buy America requires that all manufactured products be produced in the United States.  For a manufactured product to be produced in the United States 1) all of the "manufacturing processes" for the product must take place in the United States and 2) all of the components must be of U.S. origin.  A component is considered to be of U.S. origin if it is manufactured in the United States, regardless of the origin of its subcomponents.  All Eggers products are in compliance with this except for our Sound Group 3 acoustical (STC) doors.

 

It is important to review which of the “Buy American” Acts are required for your project. The economic stimulus act is referred to as the “Buy American” provision of the American Recovery and Reinvestment Act (ARRA), the “Buy American Act of 1933” is referred to as “BAA” and the Federal Transit Administration's program is referred to as the "Federal Buy America." 

 

Eggers Industries is in compliance with all three programs unless noted above.  Our finely crafted architectural wood products are manufactured in the State of Wisconsin.  Additionally, if required, Eggers Industries can provide sources of our components used in manufacturing.
